There was interesting thing in commemoration of Muara Enim 69th anniversary (Thursday, November 19, 2015) on Merdeka Square, Muara Enim. Regent of Muara Enim awarded PT Bukit Asam (Persero) Tbk or PTBA as the largest taxpayer in Muara Enim for 2014/2015 period. The award given to PTBA General Manager Tanjung Enim Mining Unit, Wibisono on behalf of PTBA Board of Directors and its management.
Previously, many accusations adressed to PTBA related to tax payments. Including differences in estimation of land and building tax calculation for platations, minings and Forestry (PBB P3) between regional tax office (KPPP) and PTBA calculation results.
PTBA appealed through the tax courts due to excessive and unfair taxes. The unpurchased land taxes was tenfolds (IDR 103,000) compared to emplasement land tax (IDR 10,000). PTBA still being charged after theland tax being pad by other party. Productive area land tax also considered too high since calculated based on charges to income generated. The land tax became four times higher than it should. It was not in accordance with the calculation refer to the applied tax rules and regulations.
Despite the calculation difference, PTBA still paid the tax amounted of Rp54.559.494.258 or half of tax charged which was Rp109.116.988.532. However, the tax court decided that PTBA only subject to pay tax burden of Rp48.466.357.313. KPPP shall refund the excessive tax payments about 6 billion rupiah to PTBA.
